On July 17, 2027, USCIS announced they had officially received enough H-1B petitions to reach the Fiscal Year 2027 (“FY2027”) annual cap of 85,000 visas. Employers had until June 30, 2026, to file H-1B petitions for beneficiaries selected in this year's lottery. To date, USCIS has not specified how many total H-1B cap cases were received during this filing window.

United States Citizenship and Immigration Services (“USCIS”) announced on March 31, 2026, they had reached the H-1B Cap for Fiscal Year 2027 (“FY 2027”). The Service reported that it has received sufficient registrations to reach the congressionally mandated limits for the H-1B visa regular cap, as well as the advanced degree exemption (master’s cap) for FY2027and has completed the lottery selection process.

On Friday, September 19, 2025, President Trump issued a proclamation, “Restriction on Entry of Certain Nonimmigrant Workers,” putting into effect a ban on H-1B specialty occupation employees from entering the United States as of September 21, 2025, unless their employer had paid a $100,000 fee for the sponsored employee. The announcement was unclear and seemed to imply that the newly imposed fee was applicable to all H-1B visa holders who were outside of the US on the 21st of September. As a result, a frenzy besieged the employment-based immigration community with many H-1B workers receiving “urgent e-mails…with travel advisories to remain in the US and asking those outside the country to return before the 12:01AM deadline on Sunday, September 21st.
